C6.14 Temporary Custody

Introduction

​​​​​The court considers the wishes of the child’s parent or legal custodian regarding possible placements and may grant temporary custody to a relative, friend of the child or family, the Cabinet for Health and Family Services (Cabinet/CHFS), or a private child caring (PCC)/ private child placing (PCP) agency.​​

Practice Guidance

Procedure

​The SSW:

  1. Follows SOP C6.1​​​ Preparation for Court​ when a child is placed in the temporary custody of the Cabinet;
  2. Seeks authorization from the parent/custodian or judge and follows procedures outlined in SOP C7.22.2 Authorization for Medical Services​​ to provide any medical services to the child when the Cabinet places a child pursuant to a temporary custody order; and
  3. Seeks financial support from both parents for the care of the child as outlined in SOP C6.19​​ Non-Custodial Parent and Financial Support​.
