C6.19 Non-Custodial Parent and Financial Support

Legal Authority

If a child has been placed in the custody of the Cabinet or someone other than the previous custodial parent, the non-custodial parent has the right to:

Request that the child be placed with them; and
Visit with the child, unless otherwise ordered by the court, and to participate in case planning for the child.

The SSW:

Notifies the non-custodial parent, when the parent’s whereabouts are known, of all actions pending in court and all DCBS case conferences as outlined in SOP 4.20 Participants and Notification for All OOHC Cases;
Requests the court to order child support from both parents for the care of the child;
Follows and initiates the procedures as outlined in SOP 4.3 Relative and Absent Parent Search, if the non-custodial parent’s whereabouts are unknown, at the time the Cabinet is given custody of the child.
