C6.20 Procedures When the Court Orders Specific Placement

Introduction

​​​​​​​​​​​The court may recommend a specific placement of a child committed to the Cabinet for Health and Family Services (Cabinet/CHFS), but cannot order the Cabinet to place a child in a particular placement. If the court orders a particular placement at any time a child is in the custody of the Cabinet, the child may not be eligible for Title IV-E benefits. ​​

Procedure

​The SSW:

  1. Follows SOP C6.1 Preparation for Court​ when out-of-home placement of a child is considered;
  2. Consults with the FSOS and immediately notifies the Office of Legal Services (OLS) regional attorney if issues arise, such as the court ordering a specific placement.​
