12.14 Foster Home Adoption

Introduction



Practice Guidance

  • A foster home parent may adopt a child for whom parental rights have been terminated if: 
    • Foster home parent adoption is determined by Cabinet staff to be in the best interest of the child; 
    • The child resides in the foster home; and 
    • Meets the criteria in SOP 13.2 Child Freed for Adoption Procedure.

Procedure

  1. If a foster home parent expresses interest in adopting a child currently placed in the home and an alternative permanent placement is in the child’s best interest or the foster parent is not approved for the adoptive placement, Cabinet staff meet with the foster home parent prior to selection of an adoptive home to explain: 
    1. Why an alternative permanent placement is in the child’s best interest or why foster home parent adoption is not in the child’s best interest; and 
    2. The foster home parent’s right to submit a request to Cabinet to reconsider the recommendation or an administrative review within thirty (30) days of the action.
